Course Description

In this course, we'll start by outlining general agency topics to provide the foundation. Then, we'll move on to covering the recent NAR lawsuits and resulting changes to the industry. To wrap up the course, we'll explore what the future might look like and how licensees can not only survive but thrive in this new environment.

The real estate industry has undergone significant transformations, particularly related to buyer representation. The common misconception has been that real estate commissions have always been neatly split between seller's and buyer's agents and paid by the seller.

That's how it's always been, right? Well, not anymore.

Due to recent developments as a result of National Association of REALTOR® lawsuits and input from the Department of Justice, this model is changing.

These changes are reshaping the way that buyers are represented by agents and commissions are paid, and now more than ever, agents need to be prepared to shift.

Course Topics

This course covers the following topics:

  • Unit 1: Real Estate Agency and Buyer Representation

    • The concept of agency in real estate and the various types of agency relationships

    • The evolution of state laws and industry practices affecting agent responsibilities and ethical obligations to buyers and sellers

    • Agency disclosure requirements in real estate transactions

  • Unit 2: The Buyer Broker Compensation Upheaval

    • Background and legal significance of the Moehrl v. National Association of Realtors lawsuit

    • Background and legal significance of the Burnett v. National Association of Realtors lawsuit

  • Unit 3: Looking Forward

    • The impact of recent court rulings and settlements on real estate industry practices

    • Adaptation of real estate business models to create more flexible and varied consumer experiences

    • The now-mandatory negotiable nature of commissions

    • The effects of the Sitzer-Burnett v. National Association of Realtors verdict on buyer-broker compensation and commission structures

    • Key components of the 2024 National Association of Realtors Settlement Agreement

Learning Objectives

Upon completion of the course, the student will be able to:

  • Explain the evolution and fundamental principles of real estate agency and disclosure

  • Analyze the legal background and impact of the Moehrl and Burnett v. NAR lawsuits

  • Evaluate changes to buyer-broker compensation and commission negotiability

  • Summarize the key provisions and industry impact of the 2024 NAR Settlement Agreement

  • Adapt real estate business models to thrive within new legal and market requirements

General Information

Course Description

America represents equality of opportunity for ALL persons. The rich diversity of its citizens and the spirit of unity that binds us all, symbolize the principles of freedom and justice upon which this nation was founded. That is why it is disturbing when minorities, families with children, the elderly, and persons with disabilities are denied the housing of their choice because of illegal discrimination.

The Department of Housing and Urban Development (HUD) enforces the Fair Housing Act along with other federal laws that prohibit discrimination and the intimidation of people in their homes, apartment buildings, and condominium developments - and nearly all housing transactions, including the rental and sale of housing and the provision of mortgage loans.

Equal access to rental housing and homeownership opportunities is the cornerstone of this nation's federal housing policy. Owners who refuse to rent or sell homes to people based on race, color, national origin, religion, sex, familial status, or disability violate federal law, and HUD will vigorously pursue them.

Housing discrimination is not only illegal, but it also contradicts the principles of freedom and opportunity we treasure as Americans. HUD is committed to ensuring everyone is treated equally when searching for a place to call home.

This course will highlight the prominent fair housing and fair lending laws that every real estate licensee needs to be aware of when selling or leasing real property. It will also address the role that HUD plays in fair housing, the rights of LGBTQ persons, advertising issues with the Voluntary Affirmative Marketing Agreement (VAMA), and what could happen if a violation occurs.

Course Topics

This course covers the following topics:

  • Unit 1: Federal Fair Housing Laws
  • Unit 2: Federal Fair Lending Laws
  • Unit 3: Special Topics Regarding Fair Housing
  • Unit 4: The Complaint Process

Learning Objectives

Upon completion of the course, the student will be able to:

  • Explain the historical foundations and legislative framework of U.S. fair housing laws

  • Identify protected classes and prohibited discriminatory conduct in housing transactions

  • Describe the requirements of federal lending and accessibility regulations

  • Define the roles of HUD, FHEO, and industry-specific marketing agreements

  • Determine the proper procedures for reporting and processing fair housing violations
