This course is approved by the Oklahoma Real Estate Commission for 1 hour of real estate continuing education credit. This course is not endorsed, recommended, or accredited by the Commission.
Note: The information presented in the course should not be used as a substitute for competent legal advice.
Oklahoma real estate licensees operate under a statutory framework that defines the roles, duties, and responsibilities of brokers in their relationships with clients and customers. The Oklahoma Broker Relationship Act establishes these standards and provides guidance for how brokerage services are to be conducted in a lawful and professional manner.
Broker-client relationships involve specific obligations related to disclosure, confidentiality, communication, and representation. These duties apply throughout the course of a transaction and, in some cases, continue after the transaction is complete. A clear understanding of these requirements supports compliance with Oklahoma law and helps reduce the risk of disputes or disciplinary action.
This course examines the structure and application of the Oklahoma Broker Relationship Act. The material focuses on the formation of brokerage relationships, the duties owed to clients and customers, the role of brokerage agreements, and the handling of compensation and post-transaction responsibilities. Emphasis is placed on how these legal requirements apply in everyday real estate practice.
This course covers the following topics:
Broker-Client Relationships: Roles, duties, and expectations that define relationships between brokers, clients, and customers.
Disclosure and Communication Requirements: Obligations related to property information, material facts, and informed decision-making.
Brokerage Agreements and Compensation: Terms of representation, duration of agreements, and compensation structures.
Post-Transaction Responsibilities: Ongoing duties following the completion of a transaction and compliance considerations.

Category: Contracts and Forms (CON)
This course is approved by the Oklahoma Real Estate Commission for 6 hours of real estate continuing education credit. This course is not endorsed, recommended, or accredited by the Commission.
Note: The information presented in the course should not be used as a substitute for competent legal advice.
Real estate transactions in Oklahoma are governed by written contracts and standardized forms that establish the terms, conditions, and legal obligations of all parties involved. These documents provide the framework for enforceable agreements and help ensure that transactions are conducted in accordance with state and federal law.
Contracts and forms serve a critical role in reducing misunderstandings, managing risk, and protecting both clients and licensees. Key elements such as property descriptions, purchase price, timelines, disclosures, and contingencies must be clearly defined to support a smooth and compliant transaction. Proper use of standardized forms also promotes consistency and efficiency across real estate practice.
This course examines the structure and use of Oklahoma real estate contracts and forms. The material focuses on fundamental contract principles, required provisions, and the role of conditions and contingencies in protecting the interests of buyers and sellers. It also reviews commonly used forms and recent updates that impact daily real estate transactions.
This course covers the following topics:
Unit 1: Contract Basics: Core elements of contracts, including legal requirements and principles such as the Statute of Frauds.
Unit 2: Core Provisions, Conditions, and Contingencies: Key contract terms, including parties, property description, purchase price, and the use of contingencies such as financing and inspections.
Unit 3: Residential Sales Contract and Updates: Structure and application of the Oklahoma Residential Sales Contract, including recent updates and commonly used forms.
Upon completion of the course, the student will be able to:
Categorize the foundational legal principles of real estate agreements, including the Statute of Frauds, to ensure the baseline enforceability of transactions in Oklahoma.
Construct legally sound agreements by accurately identifying and detailing core contract provisions, such as party identification, property descriptions, and purchase prices.
Prioritize client protection by strategically applying contract conditions and contingencies—including financing, inspections, and title reviews—to manage and mitigate transaction risks.
Critique the impact of specialized clauses, such as "as-is" provisions, warranties, and counteroffers, to thoroughly evaluate property conditions and clarify party obligations.
Validate the accuracy of modern transactions by mastering the comprehensive structure of the current Oklahoma Residential Sales Contract and adapting to recent standardized form updates.

America represents equality of opportunity for ALL persons. The rich diversity of its citizens and the spirit of unity that binds us all, symbolize the principles of freedom and justice upon which this nation was founded. That is why it is disturbing when minorities, families with children, the elderly, and persons with disabilities are denied the housing of their choice because of illegal discrimination.
The Department of Housing and Urban Development (HUD) enforces the Fair Housing Act along with other federal laws that prohibit discrimination and the intimidation of people in their homes, apartment buildings, and condominium developments - and nearly all housing transactions, including the rental and sale of housing and the provision of mortgage loans.
Equal access to rental housing and homeownership opportunities is the cornerstone of this nation's federal housing policy. Owners who refuse to rent or sell homes to people based on race, color, national origin, religion, sex, familial status, or disability violate federal law, and HUD will vigorously pursue them.
Housing discrimination is not only illegal, but it also contradicts the principles of freedom and opportunity we treasure as Americans. HUD is committed to ensuring everyone is treated equally when searching for a place to call home.
This course will highlight the prominent fair housing and fair lending laws that every real estate licensee needs to be aware of when selling or leasing real property. It will also address the role that HUD plays in fair housing, the rights of LGBTQ persons, advertising issues with the Voluntary Affirmative Marketing Agreement (VAMA), and what could happen if a violation occurs.
This course covers the following topics:
Upon completion of the course, the student will be able to:
Assess the historical evolution and expanding scope of the Fair Housing Act to accurately recognize diverse forms of discrimination and safeguard housing rights.
Deconstruct federal fair lending legislation—such as the Equal Credit Opportunity Act, Fair Credit Reporting Act, and Home Mortgage Disclosure Act—to promote equitable consumer financing practices.
Adapt professional business operations to meet the accessibility standards of the Americans with Disabilities Act and inclusive advertising guidelines.
Examine the regulatory oversight functions of the Department of Housing and Urban Development (HUD) and the Office of Fair Housing and Equal Opportunity (FHEO) to maintain strict brokerage compliance.
Resolve potential fair housing disputes by applying the correct procedural steps to navigate consumer complaints and HUD’s formal discrimination determination process.

Professional conduct is the foundation of public trust in real estate. The National Association of REALTORS® Code of Ethics establishes the standards of practice that distinguish REALTORS® from other real estate licensees and define the profession’s commitment to integrity, fairness, and consumer protection.
First adopted in 1913, the Code of Ethics was created to elevate professional standards and protect the public from unethical practices. Over time, it has evolved to reflect changes in the marketplace while maintaining its core purpose: ensuring that buyers, sellers, landlords, tenants, and the public receive honest and competent representation. The Code extends beyond minimum legal requirements and sets measurable expectations for professional conduct.
This 3-hour continuing education course provides a comprehensive review of the Code of Ethics and Standards of Practice, including its historical development, structure, and practical application. The course reproduces the Code as adopted by the National Association of REALTORS® and examines key Articles through discussion and case study analysis.
In addition to reviewing duties owed to clients, customers, the public, and other REALTORS®, this course explains the ethics complaint process, possible disciplinary actions, and the role of mediation and arbitration. The course concludes with an overview of the Pathways to Professionalism tool, which provides guidance for maintaining respectful and professional conduct in all business interactions.
This course covers the following topics:
Upon completion of the course, the student will be able to:
Differentiate between the historical evolution of the Code and its modern 17-Article structure to distinguish professional ethical obligations from minimum legal requirements.
Outline complex duties regarding loyalty, disclosure, and cooperation to ensure ethical representation and transparent compensation practices in every transaction.
Integrate standards for truthful communication and non-discrimination into all business operations to uphold professional responsibilities to the public and peers.
Organize the procedural components of the ethics complaint process and dispute resolution—including mediation and arbitration—to navigate enforcement effectively.
Design a professional practice framework using the Pathways to Professionalism to foster consistent respect for property, the public, and the reputation of the industry.

Severe weather and natural disasters can significantly impact residential property condition, value, insurability, and marketability. From hail and flooding to earthquakes and fires, environmental events present risks that real estate professionals must understand in order to effectively support buyers and sellers.
Real estate licensees are often among the first professionals homeowners turn to when preparing for, responding to, or recovering from a weather-related event. While real estate professionals do not replace inspectors, engineers, or insurance specialists, a working knowledge of common risks, mitigation strategies, and recovery considerations is essential to competent representation.
This course examines the causes, property impacts, and practical considerations associated with major natural hazards. It explores preventive measures, visible indicators of damage, insurance implications, and appropriate referral practices. Emphasis is placed on helping professionals recognize issues that may influence disclosures, inspections, negotiations, and transaction timelines.
This course covers the following topics:
Unit 1: Hail: Formation, regional risk factors, common property damage, inspection considerations, and insurance basics.
Unit 2: Flooding: Types of flooding, mitigation strategies, FEMA flood zones, and visible indicators of past water damage.
Unit 3: Freezes: Structural impacts of freezing weather, preventive maintenance, and post-event assessment considerations.
Unit 4: Tornadoes: Development, structural vulnerabilities, preparedness features, and recovery factors affecting property condition.
Unit 5: Earthquakes: Geological causes, retrofit considerations, market impacts, and structural assessment referrals.
Unit 6: Fires: Fire risks, damage indicators, remediation documentation, and disclosure implications.
Upon completion of the course, the student will be able to:
Analyze the scientific causes and regional risk factors of diverse natural hazards—including hail, floods, freezes, tornadoes, earthquakes, and fires—to better evaluate property safety and long-term marketability.
Identify visible indicators of hazard-specific damage and structural vulnerabilities to provide clients with informed guidance during property inspections, disclosures, and valuation assessments.
Recommend comprehensive mitigation and preparedness strategies, ranging from structural retrofits to preventive maintenance, to help homeowners enhance property resilience and protect their investments.
Navigate disaster-related insurance complexities, including specific coverage exclusions, deductibles, and documentation requirements, to ensure clients understand their financial protections.
Coordinate post-event recovery and professional referrals by guiding clients through safe assessment protocols and the insurance claim process while maintaining strict professional and legal boundaries.

In this course, we'll start by outlining general agency topics to provide the foundation. Then, we'll move on to covering the recent NAR lawsuits and resulting changes to the industry. To wrap up the course, we'll explore what the future might look like and how licensees can not only survive but thrive in this new environment.
The real estate industry has undergone significant transformations, particularly related to buyer representation.
The common misconception has been that real estate commissions have always been neatly split between seller's and buyer's agents and paid by the seller.
That's how it's always been, right? Well, not anymore.
Before the 1990s, the real estate mantra was "buyer beware." In this era, the concept of a buyer's agent was virtually nonexistent. All commissions were traditionally pocketed by the listing agents, who solely represented the seller's interests.
This arrangement left buyers without representation, exposing them to exploitation and often placing them at a significant disadvantage, particularly when it came to the details of transactions and closing costs.
Because of this, real estate professionals took it upon themselves to devise a solution that would protect buyers. This led to the innovative practice of commission sharing, or "cooperative compensation," where listing agents began to share their commissions with agents who represented the buyer's interests.
Generally, these commissions were paid by the seller.
Due to recent developments as a result of National Association of REALTOR® lawsuits and input from the Department of Justice, this model is changing.
These changes are reshaping the way that buyers are represented by agents and commissions are paid, and now more than ever, agents need to be prepared to shift.
Course Disclaimers
Real estate licensees are not required to be members of any REALTOR® association to maintain licensure through their state's real estate regulatory agency. This course does not endorse or recommend specific compensation or fee structures for real estate brokerage services. No state real estate commission, department of real estate, local or state REALTOR® association, or Multiple Listing Service (MLS) recommends or suggests any set compensation amount.
To remain in compliance with antitrust laws, any content submitted by a student that includes specific commission percentages, dollar amounts, or fee structures will be flagged and removed.
Continued violation of this policy may result in removal from the course and denial of course credit.
This course covers the following topics:
Unit 1: Real Estate Agency and Buyer Representation
The concept of agency in real estate and the various types of agency relationships
The evolution of state laws and industry practices affecting agent responsibilities and ethical obligations to buyers and sellers
Agency disclosure requirements in real estate transactions
Unit 2: The Buyer Broker Compensation Upheaval
Background and legal significance of the Moehrl v. National Association of Realtors lawsuit
Background and legal significance of the Burnett v. National Association of Realtors lawsuit
Unit 3: Looking Forward
The impact of recent court rulings and settlements on real estate industry practices
Adaptation of real estate business models to create more flexible and varied consumer experiences
The now-mandatory negotiable nature of commissions
The effects of the Sitzer-Burnett v. National Association of Realtors verdict on buyer-broker compensation and commission structures
Key components of the 2024 National Association of Realtors Settlement Agreement
Upon completion of the course, the student will be able to:
Differentiate between historical agency practices and modern disclosure mandates to ensure professional compliance and ethical transparency.
Highlight the structural impact of the Sitzer-Burnett and Moehrl litigation on the future of real estate commission and representation.
Integrate the 2024 NAR Settlement requirements and mandatory negotiability into standard buyer-brokerage compensation protocols.
Design flexible business models that provide varied consumer service options in response to legal and market shifts.
Organize recent industry upheavals into a strategic framework for protecting client interests and clarifying agent responsibilities.
