Agency is one of the most important—and most misunderstood—parts of Oregon real estate practice.  In this training, we clarify what “agent” means under Oregon agency law, who a licensed Broker is an agent for (the client/principal and the Managing Principal Broker), and how third parties and customers fit into a transaction. We’ll walk through Oregon’s required agency disclosure steps, beginning with the Initial Agency Disclosure Pamphlet (OREF 042), and then moving into written representation agreements.

You’ll learn when to use OREF 015, OREF 050, and OREF 052, with a focus on key provisions like exclusivity, teams, and representation of other parties. We’ll reinforce that compensation and agency are separate—who pays does not determine representation. You’ll also review fiduciary duties and compare single agency with Oregon’s Disclosed Limited Agency, including when written consent is required and how to use OREF 040 and OREF 041.

We’ll finish with case studies on “Implied Agency and Disclosed Limited Agency” and “Loyalty, Confidentiality and Obedience.”
