​​​​​​​This course will cover several fundamental state regulations that Arizona mortgage licensees must be familiar with. Reviewing important laws in Arizona's residential mortgage loan industry will ensure that mortgage professionals are compliant with the state's expectations of behavior.

This AZ MLO CE course will cover three topics. The first module of the course will outline prohibited activities with regard to all three license types. There are some activities that are not permitted for all license categories, but then there are also activities that are specifically restricted based on how the person is licensed. It is important to understand what conduct is allowed and is not allowed.

The second module of this course specifically covers the disciplinary actions that are available to the Deputy Director of the Arizona Department of Insurance and Financial Institutions (DIFI) for detected violations of the mortgage law.

The third and last module explains the structure of the DIFI Mortgage Recovery Fund, an account set aside with the purposes of paying judgments issued against licensees who have exhausted their surety bonds or are unable to pay the judgment.

Topics and Learning Objectives

This course is broken down into several learning topics. At the end of the course a 15-question final exam will be given. The topics included in this course are:

  1. Licensee Conduct
  2. DIFI Disciplinary Actions 
  3. The Mortgage Relief Fund
  4. Final exam 

Total study time: 1 credit hour (50 minutes)

This course will prepare Arizona DIFI-licensed MLOs to:

  • differentiate loan origination activities that are prohibited for those licensed as an MLO, loan processor, mortgage broker, or mortgage banker;

  • recognize the disciplinary powers of the Deputy Director of the DIFI;

  • outline how the Deputy Director issues cease and desist orders;

  • identify the felony classes that are assigned to lending violations; and

  • illustrate how an individual can recover losses caused by licensee misconduct when the licensee's surety bond is exhausted.
