Course Description

The South Carolina Core Course (2024-2026): Legal Hot Tips is designed to help real estate professionals stay up to date on the latest legal changes, compliance requirements, and best practices in the industry.

This engaging and interactive course covers key legal topics that impact your daily work, from understanding jurisdiction and transaction brokerage to properly handling client funds and navigating the complaint process.

You'll start by exploring the foundations of real estate law in South Carolina, including the role of the South Carolina Real Estate Commission (SCREC) and the importance of property disclosures. 

From there, you'll dive into transaction brokerage, breaking down what it means to serve as a neutral party and how relationships with buyers and sellers can shift depending on agency agreements.

Money matters are also a major focus-this course will walk you through legal requirements for earnest money, trust accounts, and compensation while helping you avoid common pitfalls like commingling and wire fraud. 

Finally, you'll learn about the investigative process, common violations, and how to protect your professional standing if a complaint is ever filed against you.

Unit 1: Jurisdiction
This unit explores the role of jurisdiction in South Carolina’s real estate industry, including its historical development and importance. It explains how the South Carolina Real Estate Commission regulates the industry to ensure fairness and compliance. The unit also covers licensee responsibilities related to property disclosures and maintaining compliance with state regulations.

Unit 2: Transaction Brokerage
This unit introduces the concept of transaction brokerage and explains when it applies in real estate transactions. It outlines the duties and limitations of a transaction broker when assisting buyers and sellers. The unit also discusses the circumstances under which a licensee may transition from acting as a transaction broker to serving as an agent with fiduciary responsibilities.

Unit 3: Funds, Compensation, and Trust Monies
This unit examines how real estate professionals must handle client funds in accordance with South Carolina law. It covers the legal definitions and consequences of commingling and conversion, as well as proper procedures for managing earnest money, due diligence fees, and trust monies. Refund & Cancellation Policy

All tuition and fees paid for the course are refundable when: (a) the course of instruction is discontinued by OnlineEd and such discontinuation has prevented a student from completing the course; or (b) the enrollment of the student was procured as a result of any misrepresentation in promotion materials of the school, or representation made by an owner or employee of the school. All refunds will be completed within 30 days after the effective date of enrollment termination. Course Description

This course highlights the prominent fair housing and fair lending laws every real estate licensee needs to be aware of when selling or leasing real property. It also addresses the role that HUD plays in fair housing, the rights of LGBT persons, advertising issues with the Voluntary Affirmative Marketing Agreement (VAMA), and what course of action should be taken if a violation occurs.

This course is aligned to satisfy the National Association of REALTORS® Fair Housing training requirement for the 2025-2027 cycle.

Unit 1: Federal Fair Housing Laws

  • identify when fair housing requirements got started in the United States
  • list the types of discrimination covered by the Fair Housing Act
