Course Description

This course examines Alabama risk management from the moment a real estate offer is accepted through the signing of closing documents and the immediate post-closing period. It is organized around the Alabama Real Estate Commission's effective October 1, 2026 outline and focuses on the practical decisions that can either protect or expose a licensee during the second half of a transaction.

Topics include RECAD disclosures, agency relationships, acceptance of offers, varying purchase agreement forms, earnest money handling, contingencies, inspections, repairs, financing and TRID, insurance, title issues, settlement statements, wire fraud, final walk-through, closing, file retention, post-closing complaints, broker oversight, and prohibited rebates or kickbacks.

The course emphasizes legally accurate, practice-oriented guidance rooted in Alabama license law and Commission materials. Students are encouraged to use the course not simply as a compliance exercise, but as a working guide to clearer communication, stronger documentation, and better transaction management from signed contract to sold property.

Course Topics

Unit 1: Buyer/seller interviews and disclosures
RECAD requirements, brokerage disclosures, office policy, duties to all parties, agency disclosure in the purchase agreement, and anti-trust awareness.

Unit 2: Acceptance of offers
Offer and counter-offer process, presentation of written offers, binding contract language, communication of acceptance, backup offers, and net sheets.

Unit 3: Forms and the responsibilities of the licensee
Comparing purchase agreement forms, working with less familiar contracts, acceptance language, earnest money handling, and the limits of the licensee's contractual role.

Unit 4: From accepted offer to closing
Financing, TRID, inspections, due diligence, repairs, contingencies, "as is" issues, contract changes, insurance, title, settlement statements, wire fraud, final walk-through, and closing logistics.

Unit 5: After the Closing
Document retention, audit readiness, post-closing issues, broker involvement, trust-fund awareness, and prohibited rebates and kickbacks.
