The Florida Office of Financial Regulation (OFR or the Office) requires mortgage licensees in this state to take a one-hour course on Florida mortgage lending rules as part of the licensees' annual continuing education requirement for license renewal. This course covers the four topics outlined by OFR for licensee continuing education.

The first chapter of this course identifies the definitions located in Florida Statute 494, Loan Originators and Mortgage Brokers. The second chapter is a review of licensing requirements, including reasons for license denial and exemptions to licensing. The third chapter examines the rules and regulations that licensees must comply with in their practice of mortgage loan lending in Florida, and the fourth chapter covers the various disciplinary actions the OFR may take against licensees who are in violation of any Florida mortgage regulation.

Not every state agency allows for reinstatement of a license. Check the Annual Renewal Information page on the NMLS website to verify if the agency you are licensed under allows for reinstatement, when the last date of reinstatement is, and what the applicable penalty fees may be.


Topics and Learning Objectives

This Florida MLO online continuing education course is broken down into several learning topics. At the end of the course a 15-question final exam will be given. The topics included in this course are:

  • Module 1: State Law and Regulation Definitions
  • Module 2: License Law and Regulations
  • Module 3: Compliance 
  • Module 4: Disciplinary Action
  • Final exam

Total study time: 1 credit hour (50 minutes)

This course will prepare Florida OFR-licensed MLOs to:

  • Paraphrase definitions as they pertain to Florida laws and regulations.
  • Describe licensing requirements and procedures for loan originators and mortgage brokers, including license renewal requirements.
  • Recognize the exemptions to Florida regulations concerning licensed mortgage professionals.
  • Illustrate loan origination and mortgage broker fees.
  • Recognize the expectations and compliance requirements of mortgage licensees and lenders.
  • Review prohibited practices and license violations that should be avoided.
  • List the process for Office investigations, complaints, and examinations.
  • Identify consequences and penalties for license violations.

Students only need a computer with a functioning and accessible internet connection. This course works on all modern browsers including Microsoft Edge, Google Chrome, Mozilla Firefox, Apple Safari, and Opera. Students are responsible for internet access service charges.

Completion Requirements

This is an online mastery-based course. Students must complete all reading assignments, media activities, and pass incremental assessments to make progress. Students will be tested throughout each section to determine if they are meeting the objectives.

Completion of the course requires passing a final examination of 15 multiple choice questions with a minimum score of 70%. Students that fail a final exam may retake the final exam as many times as needed to pass. The course is expected to take approximately 1 clock hour to complete.

Issuance of Credit

After successfully passing the final exam, OnlineEd will notify the Nationwide Multistate Licensing System (NMLS) that the continuing education has been completed by the student. It is OnlineEd policy to have credit uploaded to the NMLS by the end of the following business day.

The student will have a printable course completion certificate available after passing the course final exam. The certificate is for the student's personal records and is not confirmation that the NMLS has received the notification that the student has completed the course final exam.

Policies on Cheating and Misrepresentation

Misrepresentation of personal identity is strictly forbidden for all OnlineEd courses. Falsifying personal information, forgery, and misrepresentation may result in immediate suspension. This course will instruct mortgage loan originators on a number of regulations that they will have to comply with while taking part in their mortgage loan origination activities. Rules, such as those implemented by the Dodd-Frank Wall Street Reform and Consumer Protection Act, are set in place to protect the interest and well-being of consumers who apply for mortgages to purchase or refinance their properties. To ensure that their business practices satisfy the regulations adopted by federal laws, mortgage loan originators need to keep current on the guidelines published by supervising entities.

Module 1: Top 10 Federal Topics for 2025

Study Time: 3 clock hours (150 minutes of federal law)

Licensed and registered mortgage lenders, brokers, and mortgage loan originators are required to maintain a consistent and current understanding of all regulatory requirements with which they are obligated to comply. This especially applies to individual mortgage loan originators who, in addition to their sponsoring company, will be held accountable for failures discovered through regulatory examinations and investigations involving residential mortgage loans that they originate.

The topics outlined in this module are mandated by the NMLS and state regulators, covering the more egregious regulatory compliance failures recently discovered through various regulatory examinations, investigations, and audits.

Module 2: Prohibited Kickbacks Under RESPA Section 8

Study Time: 2 clock hours (100 minutes of ethics, fraud, and consumer protection)

The Real Estate Settlement Procedures Act (RESPA) was signed into law in 1974 and became effective in June 1975. One function of RESPA was to eliminate kickbacks and unearned fees initiated by those involved in loan settlement services. Before the passage of RESPA, parties associated with the buying and selling of real estate, including lenders, real estate agents, and title companies, often engaged in undisclosed kickbacks to each other, which inflated the costs of real estate transactions and often did not properly disclose all closing costs to consumers.

While RESPA contains various consumer protection regulations, in this ethics section we're going to concentrate on the regulation's prohibitions on kickbacks and referral fees.

Module 3: Non-traditional Mortgage Products

Study Time: 2 clock hours (100 minutes of non-traditional mortgage)

Besides traditional conventional loan products, there are other options available when it comes to rehabilitating a home for purchase or refinance that might be better for the needs of a borrower.

In this module, let's explore some unique mortgage products available to borrowers that may better fit their needs compared to a conventional mortgage loan These other options include the FHA 203(k) property rehabilitation loan, four types of energy efficient mortgage products, and the Fannie Mae HomeReady® rehab loan product.
