Course Goals:

This course is designed to give the license a comprehensive understanding of the required six basic topics of fair housing, agency, ethics, trust funds, risk management, and broker management and supervision in an eight-hour course format.

  1. The fair housing segment gives a brief historical perspective on the fair housing laws followed by a more detailed discussion of the more important federal fair housing law provisions. The fair housing laws specific to the State of California and its local jurisdictions are also included.
  2. The agency segment briefly discusses common law agency concepts. Special attention is focused on fiduciary duties arising out of the agency relationship between licensee and the client. The specific requirements of the California agency disclosure law is also discussed.
  3. The ethics segment is introduced by a brief discussion of ethics and doing business as a real estate licensee. Specific examples of prohibited conduct with respect to clients and/or customers is then examined. A discussion of a licensee's ethical duties to the general public is also presented.
  4. The trust fund segment discusses the general concept of trust funds and specifically addresses the many technical requirements of trust fund handling and record keeping requirements. Discussion of trust fund commingling and conversion is also included.
  5. The risk management segment introduces the student to the concept of risk management and potential consequences that risk presents if not managed properly. The student is introduced to the three main areas of legal liability: contract, tort and violation of law. Specific major areas or risk are discussed. The course segment also provides the student with a strategy, which if followed, will assist the licensee in minimizing risk.
  6. The management and supervision segment is an overview of the supervisory responsibilities that brokers have over their salespersons or other associated brokers. This segment will explore the role of the broker, what components make a good office policy manual, rules for advertisements, and branded team names. Management and Supervision is a new CE topic category required by the CalBRE to be included in all Survey courses as of January 1, 2016.

Delivery

This is a correspondence course provided via the internet. The course material is made available as an electronic download after registration. After studying the material, students will need to complete an online quiz for each chapter and pass an online final exam at the end of the course.

No other method of taking or completing this course is allowed.

Course Materials:

This course is composed of approximately 8 hours of reading material. The course is divided into segments with a review quiz at the end of each segment.

At the end of the course, a final examination is required. The final exam is administered online. Access to the final exam will only be granted once the security information entered at the time of course enrollment is verified by OnlineEd's system.

The final examination consists of 20 multiple choice questions. A test score of 70% or greater is required for course completion. The final examination is not downloadable or printable.

The final exam has a time limit of one minute per question served, for a total of 20 minutes available for the final exam as required by current California Bureau of Real Estate regulations.

CalBRE requirements allow for ONE re-take of a failed final exam. Retake exams will consist of different questions than those served on the first attempt. A second failure will result in a failing score for the entire course and the course must be retaken for credit.

Course Identification Statement

In order to verify your identity, you will be asked to provide at the time of enrollment and again prior to taking the final examination certain information to verify your identity. Among the types of identification that may be asked for are your current California driver's license, current identification permitted under the California Vehicle Code, or any identification issued to you by a governmental agency or a recognized real estate related trade organization that was issued within the immediately preceding five years that bears your photograph, signature, and identification number. In addition, you will also be asked to provide answers to additional security questions, the answers to which are unique to you.

Refund Policy

All tuition and fees paid for the course are refundable when: (a) the course of instruction is discontinued by OnlineEd and such discontinuation has prevented a student from completing the course; or (b) the enrollment of the student was procured as a result of any misrepresentation in promotion materials of the school, or representation made by an owner or employee of the school. All refunds will be completed within 30 days after the effective date of enrollment termination. Refunds will not be given to any student after the student has successfully registered in a course or courses, as once registered, student has access to the registered courses.  In hardship cases, OnlineEd may issue a refund at its sole discretion. OnlineEd does not issue retroactive partial refunds for courses that are subsequently discounted or put on sale after a student makes a purchase.
